If you wish to rent the property we will speak to the Landlord on your behalf to get everything agreed in principle before you are required to complete application forms and pay your holding deposit.

The Next Step - Application and referencing

Once a tenancy has been agreed in principle, references will be required for all tenants.

An application form and holding deposit should be returned to SAS Letting Agents Ltd to allow the property to be marked as RESERVED, providing exclusivity to you.

The Next Step – Moving in to your new home

Once acceptable references have been received we can confirm a date to move into the property. Your first month’s or week’s rent must be paid in cleared funds (cash or bankers draft). Personal or company cheques can be accepted if sufficient clearance time of 7 working days is allowed.

You should have contents insurance in place to cover your belongings in the property. Our Lettings team will be happy to advise you upon specialist tenant insurance products available.

On the day that you move into the property, an appointment will be made for you to visit the office to read and sign the tenancy agreements and to pay your first month’s or week's rent along with your deposit. We will also review the inventory for the property with you which you will be required to sign.

Tenancy Agreement

A tenancy agreement is a legal document signed by the Landlord (or agent) and Tenant that identifies the rights and responsibilities of each party in line with the occupation of a property. SAS Letting Agents Ltd will prepare the tenancy agreements for the letting of each property, tailoring it to match the requirements of the Landlord and Tenant. Most commonly an Assured Shorthold Tenancy Agreement is used, with a minimum term of six months.

Deposit

The deposit is paid by the Tenant to the Landlord or their agent prior to taking occupation of the property. The Housing Act 2004, introduced Tenancy Deposit Protection for all tenant deposits paid from 6th April 2007. SAS Letting Agents Ltd currently utilise the Deposit Protection Service (DPS Custodial) in line with this legislation. Click the link below for more information. www.depositprotection.com

ANTI SOCIAL BEHAVIOUR

The term anti-social behaviour covers any behaviour that would cause a nuisance, unreasonable disturbance or harassment.
Everyone is entitled to enjoy their home quietly and peacefully. You must not make too much noise, be a nuisance or disturb your neighbours and you must also make sure that anyone living with you or visiting your home behaves in a reasonable way.
Your tenancy agreement makes you responsible for ensuring that you or your family or your visitors do not harass anybody. If you or members of your household or visitors to your home are found to be responsible for acts of harassment, you would be in breach of your tenancy agreement and could be evicted from your home.

Receiving the Keys

ENDING YOUR TENANCY

Once the initial 6 month term has expired you are required to give us at least four weeks' written notice before leaving your home and to leave your home in a clean and tidy condition.
It is important that you keep to this agreement otherwise you may be charged extra rent, or have to pay for any extra work we have to carry out before new tenants can move in.
1 - Give us at least 28 days' written notice.
When you intend to leave your home, you must give us at least 28 days' written notice. This is a legal requirement of your tenancy agreement.
2 - Continue paying your rent until your notice period expires.
Please remember you are responsible for paying your rent until your notice period expires.
3 – Forwarding Address.
Please issue us with your new address before you leave the property to enable us to inform utility providers that you have left the property. We will not forward mail to you after you have left the property.
4 - Clean your home when you move.
To help us re-let your home quickly, we require you to leave it - and your garden (if you have one) - in a clean and reasonable condition. Please make sure that both are clear of rubbish and your home is in a good state of repair. Repairs that are needed and are not your responsibility must be reported to us. Otherwise, we will charge you for the extra cleaning or repairs work.
5 - Hand over your keys to SAS Letting Agents Ltd.
You must hand in the keys (main keys together with any garage or communal door keys) at our main office. We will give you a receipt for your keys. If you do not hand in your keys you will have to pay another rent payment and pay for new keys to be issued via a locksmith. Before you leave, please make the property safe by locking all the doors and closing all windows.
6 - Pay all outstanding rent.
As a matter of policy, we chase up all outstanding arrears on your rent account - no matter how small they are. Please make sure that you pay the full amount of money you owe before you leave your home. Otherwise the debt will be passed on to a debt collection company which could result in a County Court Judgement.

Landlord Obligations

There are several legal obligations that a Landlord is required to meet at all times.

  • Energy Performance Certificate (EPC) – This is required for all rental properties being marketed to let, from 1st October 2008. We have qualified Domestic Energy Assessors able to produce these certificates which can remain valid for ten years.

  • Tenancy Deposit Protection – This applies to all Assured Shorthold Tenancies (AST’s) in England and Wales where a deposit is taken. Under this legislation Landlords are required to join a statutory tenancy deposit scheme if they take deposits, meaning that deposits are safeguarded so that tenants will get all or part of their deposit back, if they have kept the property in good condition and entitled to get it back. There are two types of schemes that are available; custodial and insurance based schemes.

  • Taxation- as a Landlord you are required to pay tax on the income you receive, but the taxation level depends on whether you are classified as a UK resident or an overseas Landlord. If you are going to be living overseas whilst your property is let you will need to complete form ‘NRL 1’ prior to the property being let. For more information speak to a member of the Residential Lettings Team.

  • Lender Consent- If the property is mortgaged, consent to the letting of your property must be obtained from your lender, to avoid a breach of your mortgage terms.

  • Compliance with Safety Regulations The following regulations must be adhered to before the property can be let:

    1. Gas Safety (Installation and Use) Regulations 1998 (as amended).

    2. Landlord and Tenant Act 1985

    3. The Electrical Equipment (Safety) Regulations 1994.

    4. The Furniture and Furnishings (Fire) (Safety) Regulations 1988.

    5. Consumer Protection Act 1987 and Housing Order 1997 - General Product Safety.

    6. Smoke Alarms- recommended that at least one is fitted to each floor of your property.
